ریلوے کی زمین پر غیر قانونی تعمیر کا معاملہ

آّمبور کے مضافاتی علاقے گووندھاپورم میں، جہاں قومی شاہراہ کی رفتار زندگی کی دھڑکن کے ساتھ چلتی ہے، وہاں آج ایک خاموش مگر گونجتی ہوئی کارروائی نے کئی سوالات کو جنم دیا۔ ریلوے محکمہ کی زمین پر غیر قانونی طور پر قائم کی گئی چائے اور پھلوں کے رس کی دکان کو حکام نے جے سی بی مشین کے ذریعے منہدم کر دیا۔
اطلاعات کے مطابق، مقامی شخص شیکر نے دو سال قبل اس زمین پر قبضہ کر کے ایک عمارت تعمیر کی تھی، جسے بعد میں کیرالہ کے ملپورم سے تعلق رکھنے والے تاجر محمد کویا کو کرائے پر دے دیا گیا۔ اسی عمارت کے ایک حصے میں سیاسی علامت کے طور پر ایک پارٹی کا جھنڈا بھی نصب کیا گیا، جو اس معاملے کو محض ایک قانونی مسئلہ نہیں بلکہ سماجی و سیاسی رنگ بھی دیتا ہے۔
کہا جاتا ہے کہ ریلوے حکام کی ابتدائی وارننگ کے باوجود اس غیر قانونی تعمیر کو نظر انداز کیا گیا۔ بالآخر، Madras High Court کے حکم (31 جولائی 2024) کے بعد کارروائی تیز ہوئی، اور 14 اپریل کو نوٹس جاری کیا گیا۔ مگر جب اس نوٹس کو بھی سنجیدگی سے نہ لیا گیا، تو آج ریلوے، پولیس اور محکمہ مال کے اہلکاروں نے مشترکہ کارروائی کرتے ہوئے اس دکان کو مسمار کر دیا۔
اس اچانک انہدام نے علاقے کے تاجروں اور عوام میں بے چینی کی لہر دوڑا دی۔ سب سے زیادہ متاثر وہ کرایہ دار محمد کویا رہے، جنہیں پیشگی اطلاع تک نہ دی گئی۔ ان کی روزی روٹی ایک لمحے میں مٹی کا ڈھیر بن گئی، اور وہ مستقبل کی غیر یقینی میں کھڑے رہ گئے۔
یہ واقعہ ایک بار پھر اس سوال کو زندہ کرتا ہے کہ
کیا ترقی کے راستے میں قانون کی بالادستی ہی اصل انصاف ہے، یا اس کے ساتھ انسانی ہمدردی کی بھی کوئی جگہ ہونی چاہیے؟
Between Encroachment and Enforcement — Illegal Shop Demolished Near Ambur
In Govindapuram, near Ambur along the busy Chennai–Bengaluru National Highway, a seemingly routine administrative action unfolded into a moment of tension and reflection. A tea and fruit juice shop, allegedly built on railway land through encroachment, was demolished using a JCB machine by authorities.
Reports indicate that a local resident, Sekar, had constructed the structure two years ago on land belonging to the Railways and later rented it out to a businessman, Mohammed Koya, from Malappuram, Kerala. A portion of the premises was also reportedly allocated for installing a political party flagpole, adding a symbolic dimension to the issue.
Despite earlier warnings from railway officials, the encroachment remained. Acting upon an order dated July 31, 2024, issued by the Madras High Court, authorities served a notice on April 14. With no compliance from the concerned party, officials from the Railways, police, and revenue department jointly carried out the demolition.
The sudden action created unrest among local residents and traders along the highway. The most affected was the tenant, Mohammed Koya, who claimed he had not been informed beforehand. His livelihood was reduced to rubble within moments, leaving him uncertain and distressed.
This incident raises a deeper question:
Is the strict enforcement of law alone sufficient for justice, or must it be balanced with compassion for those whose lives are disrupted in the process?
