Madras High Court Allows RSS Marches Across 128 Locations, Criticises Tamil Nadu Police

Court says police cannot repeatedly rely on grounds already rejected in earlier judicial proceedings

Chennai, October 16, 2026

The Madras High Court has permitted the Rashtriya Swayamsevak Sangh (RSS) to conduct route marches across 128 locations in Tamil Nadu on October 25 and November 1, while strongly criticising the State police for repeatedly refusing permission on grounds that had already been disapproved by the courts.

Justice V. Lakshminarayanan, while hearing the matter on Friday, observed that despite several orders of the High Court and the Supreme Court, the Tamil Nadu Police had continued to rely on the same reasons to deny permission for the processions.

The judge remarked that the only credit due to the police was that it had not come up with any new grounds for rejection, but had consistently repeated reasons that the Court had already found weak and unacceptable.

The case arose from an application submitted by the RSS State Secretary on October 3, seeking permission to organise route marches and public meetings as part of the organisation’s Vijayadashami celebrations. The organisation had proposed October 18, October 25 and November 1 as alternative dates.

The police rejected the applications citing the presence of places of worship belonging to other communities along the proposed routes, statues of rationalist leaders, traffic congestion, the use of loudspeakers and the possibility of law-and-order problems. The Court, however, noted that several of these objections had already been considered in earlier proceedings involving the RSS.

Public roads are open to everyone

Tracing the litigation back to 2022, the Court referred to earlier judicial decisions recognising the RSS’s right to conduct route marches, subject to lawful restrictions. It also referred to a 2023 ruling which held that public roads are secular spaces accessible to everyone, irrespective of religion, caste or creed.

Commenting on the police’s approach, Justice Lakshminarayanan observed that the case resembled the use of a surgical instrument not to operate on a patient but to kill the very person the operation was intended to treat.

During Friday’s hearing, Advocate General Vijay Narayan informed the Court that the State was agreeable to permitting the processions on October 25 and November 1, subject to modifications suggested by local police authorities in view of prevailing circumstances.

The RSS also submitted details of the proposed processions, including their routes, organisers, expected number of participants and venues for public meetings. The Court directed that these details be annexed to its order to prevent subsequent disputes.

The Court also recorded the organisation’s undertaking to comply with conditions imposed in earlier judicial proceedings.

Police urged to facilitate permissions

The judge cautioned that the police should not adopt an inflexible approach by attempting to force every situation into a predetermined framework.

The Court emphasised that police authorities should examine applications with a view to processing and granting permission wherever legally permissible, rather than searching for defects to justify rejection. It also advised RSS organisers to submit applications sufficiently in advance.

The Court expressed hope that disputes of this nature would not continue to consume judicial time. It directed the police not to prolong the matter and to coordinate with the RSS organisers to finalise the timings and locations of the marches and subsequent public meetings by October 19.

Senior Advocate N. L. Rajah appeared for the petitioner. Advocate General Vijay Narayan represented the State, assisted by Public Prosecutor John Sathyan and Additional Public Prosecutor Arun Anbumani.
