Democracy on Trial: The Sanctity of the Vote and the Right to Dissent

The voices rising from the streets of Delhi are more than the noise of a political demonstration. They echo a fundamental question confronting Indian democracy: who will protect the people’s vote, their freedom of choice and their constitutional rights—and who will answer when doubts arise about the institutions entrusted with safeguarding them?

On 12 October, thousands gathered in central Delhi as Opposition parties, student organisations, youth activists and civil society groups joined a major mobilisation demanding the resignation of Chief Election Commissioner Gyanesh Kumar and an immediate halt to the Special Intensive Revision (SIR) of electoral rolls. Led by Leader of Opposition Rahul Gandhi, the INDIA bloc’s proposed march towards the Supreme Court brought together leaders and supporters of the Congress, Trinamool Congress, Samajwadi Party, Rashtriya Janata Dal, Left parties and other Opposition formations. Members and supporters of the Cockroach Janta Party (CJP), the All India Students’ Association (AISA) and other student groups also participated.

The protest has unfolded amid growing questions about the procedures governing electoral roll revision, alleged irregularities and the impartiality of the electoral process. Such allegations must be examined through evidence and appropriate legal proceedings rather than accepted or dismissed merely on political grounds. Yet a democracy cannot afford to treat public concerns about elections as an inconvenience. The Election Commission and the government must ensure that the process is transparent, accountable and capable of commanding public confidence.

The correction of electoral rolls is undoubtedly essential. But what happens when an eligible voter’s name is wrongly removed? It is not simply an administrative error. It can deprive a citizen of the opportunity to exercise a fundamental democratic choice. Accuracy must therefore go hand in hand with safeguards, accessible remedies and clear procedures that protect every eligible voter.

The heavy security deployment in the national capital, attempts by demonstrators to push through police barricades and restrictions affecting public movement have added another dimension to the unfolding confrontation. Reports indicate that protests on 10 and 11 October were accompanied by a major police crackdown, with political leaders, student activists and CJP supporters among those detained. Ahead of Monday’s mobilisation, more than 30,000 police and paramilitary personnel were reportedly deployed across Delhi. Six Metro stations were temporarily closed, while traffic restrictions affected several roads.

Security is a legitimate responsibility of the authorities. But the scale of a security operation also raises an important question: how can public order be maintained without undermining the democratic right to peaceful assembly? A constitutional democracy must be capable of protecting both. The right to protest cannot mean freedom from every lawful restriction, but neither should the management of public order become a pretext for making dissent practically impossible.

Another significant development came when Opposition leaders sought a meeting with Chief Justice of India Justice Surya Kant to submit a memorandum concerning alleged electoral irregularities, the SIR exercise and their demand for the Chief Election Commissioner’s resignation. The Chief Justice declined the request for a private meeting, citing pending judicial proceedings, and advised the leaders to approach the Supreme Court through a formal petition.

The independence of the judiciary and respect for established judicial procedures are indispensable to the rule of law. The issues raised by the Opposition must therefore be pursued through appropriate legal channels, where claims can be tested against evidence and considered according to constitutional principles. Neither political rhetoric nor public anger can substitute for a fair judicial examination.

The Delhi Police’s announcement that Jantar Mantar would no longer remain a designated protest site, with Ramlila Maidan, Burari Ground and CBD Ground identified as alternatives, also deserves careful scrutiny. The authorities must take account of traffic congestion, public convenience and security concerns. Yet changing designated venues must not become a means of narrowing the practical space available for peaceful dissent. A protest site should be accessible enough for citizens to assemble, express their concerns and make themselves heard.

Democracy is not defined merely by the holding of elections. It rests equally on the public’s confidence that every eligible vote matters, that institutions act impartially and that those exercising authority remain accountable. The right to dissent is an essential part of this compact. At the same time, protesters must avoid violence and confrontation, while law enforcement agencies must act proportionately and refrain from unnecessary force.

India now needs less political hostility and more institutional transparency. Concerns surrounding electoral roll revision must be addressed through credible explanations, effective safeguards, impartial scrutiny and accessible legal remedies. If allegations are unfounded, evidence should establish that. If shortcomings exist, correcting them will strengthen the democratic process rather than weaken it.

The true test of a democracy is not whether it can silence disagreement, but whether it can preserve public trust while disagreement is allowed to flourish. The sanctity of the vote is not the possession of any political party; it is a public trust upon which the future of the entire nation depends.
