کسی تعمیر کی قانونی حیثیت کا فیصلہ صرف عدالتیں کر سکتی ہیں، انتظامیہ نہیں۔

مسلم تنظیموں کا مذہبی ڈھانچوں کی مسماری پر شدید اظہارِ تشویش

نئی دہلی، 25 جون: ملک کی متعدد نمایاں مسلم تنظیموں نے مختلف ریاستوں میں مساجد، مدارس، درگاہوں اور دیگر مذہبی و رہائشی ڈھانچوں کے انہدام پر گہری تشویش ظاہر کرتے ہوئے اسے آئینی اصولوں اور قانون کی حکمرانی کے منافی قرار دیا ہے۔ تنظیموں نے متاثرہ فریقوں کو قانونی امداد فراہم کرنے اور عدالتوں سے رجوع کرنے کا فیصلہ بھی کیا ہے۔

جمعیۃ علماء ہند کے صدر مولانا ارشد مدنی نے کہا کہ اگر حکومتیں عدالتوں کے بجائے بلڈوزر کے ذریعے فیصلے کرنے لگیں تو قانون کی حکمرانی اور شہری حقوق کی حیثیت متاثر ہوتی ہے۔ ان کے مطابق کسی تعمیر کی قانونی حیثیت کا فیصلہ صرف عدالتیں کر سکتی ہیں، انتظامیہ نہیں۔

جماعت اسلامی ہند نے بھی مختلف ریاستوں میں مذہبی مقامات اور رہائشی عمارتوں کے خلاف انہدامی کارروائیوں پر تشویش ظاہر کرتے ہوئے کہا کہ تنظیم ایسے تمام متاثرین کی قانونی مدد جاری رکھے گی جن کے خلاف قانونی تقاضے پورے کیے بغیر کارروائی کی گئی ہو۔ جماعت نے شہریوں کے وقار، مساوات اور آئینی حقوق کے تحفظ کو جمہوری نظام کی بنیاد قرار دیا۔

دوسری جانب آل انڈیا مسلم پرسنل لا بورڈ نے راجستھان سمیت مختلف علاقوں میں مساجد اور مدارس کے خلاف کارروائیوں پر تشویش کا اظہار کرتے ہوئے اعلان کیا کہ وہ انصاف پسند شہریوں اور سماجی تنظیموں کے تعاون سے ملک گیر عوامی مہم شروع کرے گا۔ بورڈ کے مطابق اس مقصد کے لیے ایک عملی کمیٹی بھی تشکیل دی جا رہی ہے۔

بورڈ کے اجلاس میں اقلیتی برادری کو درپیش مسائل، مذہبی مقامات کے انہدام، گھروں پر بلڈوزر کارروائیوں اور ہجومی تشدد کے واقعات پر بھی غور کیا گیا۔

دہلی اقلیتی کمیشن کے سابق چیئرمین ظفر الاسلام خان نے نوجوانوں سے امن و ضبط برقرار رکھنے کی اپیل کرتے ہوئے کہا کہ ایسے معاملات میں قانونی راستہ اختیار کرنا ہی جمہوری نظام کے استحکام کے لیے ضروری ہے۔

ذرائع کے مطابق مختلف مسلم تنظیمیں راجستھان اور اتر پردیش کی متعلقہ عدالتوں میں درخواستیں دائر کرنے کی تیاری کر رہی ہیں تاکہ انہدامی کارروائیوں کو قانونی جانچ کے دائرے میں لایا جا سکے اور متاثرہ مذہبی مقامات سے متعلق عدالتی رہنمائی حاصل کی جا سکے۔

Muslim Organisations Condemn Demolition of Religious Structures, Plan Legal Action

New Delhi, June 25: Several prominent Muslim organisations have expressed serious concern over the demolition of mosques, madrasas, dargahs, and other structures in different Indian states, describing such actions as inconsistent with constitutional principles and the rule of law. The organisations have also announced plans to extend legal assistance to affected communities and seek judicial remedies.

Jamiat Ulama-i-Hind President Maulana Arshad Madani said that decisions regarding the legality of any structure should be made by courts rather than executive authorities. He argued that governance based on demolition drives instead of due judicial process raises important questions about constitutional rights and the rule of law.

Jamaat-e-Islami Hind also voiced concern over demolition drives affecting religious sites and residential buildings. The organisation said it would continue supporting victims through legal means wherever actions were allegedly taken without following due legal procedure. It emphasised that protecting the dignity, security, and constitutional rights of all citizens is essential to a democratic society.

Meanwhile, the All India Muslim Personal Law Board (AIMPLB) criticised the demolition of mosques and madrasas in parts of Rajasthan and announced plans to launch a nationwide campaign, in cooperation with people committed to justice and constitutional values. The Board also decided to constitute an action committee to coordinate legal and public initiatives.

During its meeting in New Delhi, the Board reviewed issues concerning the Muslim community, including demolition drives, alleged incidents of mob violence, and actions affecting religious institutions.

Former Delhi Minorities Commission Chairman Zafarul Islam Khan urged young people to remain peaceful and pursue constitutional and legal remedies, stressing the importance of maintaining social harmony.

According to the organisations, petitions are being prepared for filing before the High Courts in Rajasthan and Uttar Pradesh to challenge the demolition actions and seek judicial relief where required.

The Constitution, the rule of law, and freedom of religion are fundamental pillars of a democratic republic. In matters involving places of worship and citizens’ rights, transparency, due process, judicial oversight, and equal protection under the law remain essential for justice, public confidence, and social harmony.
