مسلم خواتین کے حقوق پر نئی گفتگو — انصاف کی راہوں میں مزید روشنی کی تلاش

نئے قوانیں شریعتِ اسلامی کے دائرے میں بنائے جائیں

نئی دہلی، 28 مئی:

ایک ایسے وقت میں جب ہندوستان میں خواتین کے حقوق، سماجی انصاف اور آئینی مساوات پر بحث مسلسل جاری ہے، قومی کمیشن برائے خواتین نے مسلم خواتین کے حقوق سے متعلق ایک جامع سفارشاتی رپورٹ وزارتِ داخلہ، وزارتِ خواتین و اطفال کی بہبود اور وزارتِ اقلیتی امور کے حوالے کر دی ہے۔

یہ رپورٹ ملک گیر سطح پر ہونے والی مشاورت اور مکالمے کے بعد تیار کی گئی، جس کا مقصد مسلم خواتین کے قانونی، سماجی اور آئینی حقوق کو مزید مضبوط اور مؤثر بنانا ہے۔

کمیشن نے اپنی رپورٹ میں اس حقیقت کا اعتراف کیا ہے کہ آئینی تحفظات اور حالیہ قانونی اصلاحات نے خواتین کے حقوق کے فروغ میں اہم کردار ادا کیا ہے، تاہم اب بھی قانونی آگہی میں اضافے، انصاف تک رسائی کو آسان بنانے اور شخصی قوانین میں مزید وضاحت و یکسانیت پیدا کرنے کی گنجائش موجود ہے۔

مشاورت کے دوران نکاح، طلاق، نان و نفقہ، بچوں کی سرپرستی اور وراثت جیسے حساس اور اہم موضوعات پر خصوصی توجہ دی گئی۔ رپورٹ میں اس بات پر زور دیا گیا کہ خواتین کو اپنے حقوق کے بارے میں بہتر معلومات فراہم کی جائیں تاکہ وہ قانون کی روشنی میں اپنے جائز حقوق کا مؤثر دفاع کر سکیں۔

اس جائزے میں مسلم خواتین سے متعلق مختلف قوانین کا بھی مطالعہ کیا گیا، جن میں مسلم پرسنل لا (شریعت) ایکٹ 1937، فسخِ نکاحِ مسلمین ایکٹ 1939، مسلم خواتین (تحفظِ حقوق برائے طلاق) ایکٹ 1986 اور مسلم خواتین (تحفظِ حقوق برائے نکاح) ایکٹ 2019 شامل ہیں۔

یہ رپورٹ محض قانونی سفارشات کا مجموعہ نہیں بلکہ اس سوال کا بھی اظہار ہے کہ ایک جمہوری معاشرے میں خواتین کو انصاف، وقار اور مساوی مواقع فراہم کرنے کے لیے مزید کون سے راستے اختیار کیے جا سکتے ہیں۔ آنے والے دنوں میں یہ دیکھنا اہم ہوگا کہ متعلقہ وزارتیں ان سفارشات پر کس حد تک غور کرتی ہیں اور ان کے نتیجے میں مسلم خواتین کی زندگیوں میں کیا عملی تبدیلیاں رونما ہوتی ہیں۔

انصاف صرف عدالتوں کے فیصلوں سے نہیں بلکہ شعور، آگہی اور مساوی مواقع کی فراہمی سے بھی پروان چڑھتا ہے۔ معاشروں کی اصل ترقی اسی وقت ممکن ہوتی ہے جب ان کی خواتین خود کو محفوظ، بااختیار اور باوقار محسوس کریں۔

تاہم اس بحث کا ایک اہم پہلو وہ بھی ہے جسے نظر انداز نہیں کیا جا سکتا۔ مسلم معاشرے کے ایک بڑے طبقے کا موقف ہے کہ نکاح، طلاق، نان و نفقہ، وراثت اور خاندانی زندگی سے متعلق دیگر معاملات محض سماجی یا قانونی مسائل نہیں بلکہ براہِ راست اسلامی شریعت سے وابستہ احکام ہیں، جن کی بنیاد قرآنِ کریم اور سنتِ نبویؐ پر قائم ہے۔

اس نقطۂ نظر کے مطابق ان معاملات میں کسی بھی اصلاح، ترمیم یا قانون سازی کو اسلامی تعلیمات کے دائرے میں رہ کر ہی انجام دیا جانا چاہیے۔ مسلمانوں کا ماننا ہے کہ جہاں آئینِ ہند مذہبی آزادی اور اپنے مذہبی معاملات پر عمل کرنے کا حق دیتا ہے، وہاں شخصی قوانین میں ایسی مداخلت جو قرآن و سنت کے واضح احکام سے متصادم ہو، نہ صرف قابلِ اعتراض ہوگی بلکہ مذہبی آزادی کے بنیادی اصولوں سے بھی متصادم سمجھی جائے گی۔

اسی لیے بہت سے اہلِ علم اور دینی حلقے اس بات پر زور دیتے ہیں کہ مسلم خواتین کے حقوق کے تحفظ اور ان کی فلاح و بہبود کی ہر کوشش خوش آئند ہے، لیکن اس عمل میں شریعتِ اسلامی کے بنیادی اصولوں، مذہبی حساسیتوں اور آئینی ضمانتوں کو ملحوظ رکھنا ناگزیر ہے۔ بصورتِ دیگر ایسے اقدامات غیر ضروری تناؤ، اختلاف اور تنازع کا سبب بن سکتے ہیں، جبکہ اصل مقصد انصاف، احترام اور معاشرتی ہم آہنگی کا فروغ ہونا چاہیے۔

A New Conversation on the Rights of Muslim Women

New Delhi, May 28:

At a time when questions of justice, equality, and women’s empowerment continue to shape public discourse in India, the National Commission for Women has submitted a comprehensive recommendatory report on the rights of Muslim women to the Ministry of Home Affairs, the Ministry of Women and Child Development, and the Ministry of Minority Affairs.

The report is the outcome of extensive nationwide consultations aimed at strengthening the legal, social, and constitutional rights of Muslim women across the country.

The Commission acknowledged that constitutional safeguards and recent legal reforms have contributed significantly to advancing women’s rights. However, it noted that there remains considerable scope for improving legal awareness, expanding access to justice, and ensuring greater clarity and consistency in the application and codification of personal laws.

Particular attention was given to issues relating to marriage, divorce, maintenance, child custody, and inheritance—areas that directly affect the everyday lives and dignity of women.

The consultation also reviewed major legislations concerning Muslim women, including the Muslim Personal Law (Shariat) Application Act, 1937; the Dissolution of Muslim Marriages Act, 1939; the Muslim Women (Protection of Rights on Divorce) Act, 1986; and the Muslim Women (Protection of Rights on Marriage) Act, 2019.

Beyond legal recommendations, the report reflects a broader national conversation about how justice, dignity, and equal opportunity can be strengthened for women in a democratic society. The coming months will reveal how the concerned ministries respond to these recommendations and whether they translate into meaningful improvements in the lives of Muslim women.

Justice flourishes not only through laws and courtrooms but also through awareness, education, and equal opportunities. A society moves forward when its women are able to live with security, dignity, and confidence in their rights.

However, there is another important dimension of this discussion that cannot be overlooked. A significant section of the Muslim community maintains that matters relating to marriage, divorce, maintenance, inheritance, and family life are not merely social or legal concerns; rather, they are religious obligations directly governed by Islamic Shariah, founded upon the teachings of the Holy Qur’an and the Prophetic Sunnah.

According to this perspective, any reform, amendment, or legislative initiative concerning these matters should remain within the framework of Islamic principles. Many Muslims argue that while the Constitution of India guarantees equality before the law, it also safeguards religious freedom and the right of communities to practice and manage their religious affairs. Consequently, any interference in personal laws that contradicts the clear injunctions of the Qur’an and Sunnah would be regarded not only as objectionable but also as inconsistent with the constitutional spirit of religious liberty.

For this reason, many scholars and religious leaders emphasize that every sincere effort aimed at protecting the rights, dignity, and welfare of Muslim women is welcome and worthy of appreciation. At the same time, they stress that such efforts must remain mindful of the fundamental principles of Islamic Shariah, religious sensitivities, and constitutional guarantees. Otherwise, measures intended to promote justice may inadvertently give rise to unnecessary tension, disagreement, and social discord, whereas the ultimate objective should be the advancement of justice, mutual respect, and social harmony.

In a diverse and plural society, lasting solutions are often found not through confrontation but through dialogue, understanding, and a careful balance between constitutional values and the deeply held religious convictions of its communities.
