عظیم نکوبار منصوبہ: کلکتہ ہائی کورٹ نے قبائلی حقوق سے متعلق عرضیوں کو قابلِ سماعت قرار دے دیا

Calcutta High Court نے عظیم نکوبار انفراسٹرکچر منصوبے سے متعلق ایک اہم فیصلے میں اُن عوامی مفاد کی عرضیوں (PILs) کو قابلِ سماعت قرار دے دیا ہے جن میں جنگلاتی حقوق اور قبائلی تحفظات کی خلاف ورزیوں کا الزام عائد کیا گیا تھا۔ عدالت نے خاص طور پر جزائر کے قبائلی باشندوں کو انتہائی کمزور اور غیر محفوظ قرار دیتے ہوئے کہا کہ ایسے طبقات کی آواز عدالت تک پہنچانا ہر باشعور شہری کا حق ہے۔

چیف جسٹس Sujoy Paul اور جسٹس Partha Sarathi Sen پر مشتمل بنچ نے مرکزی حکومت کے اس اعتراض کو مسترد کر دیا کہ درخواست گزار Meena Gupta چونکہ حیدرآباد کی رہائشی ہیں، اس لیے انہیں مقدمہ دائر کرنے کا اختیار حاصل نہیں۔

عدالت نے اپنے مشاہدے میں کہا کہ اگر کوئی غریب، محروم یا سماجی طور پر کمزور طبقہ خود عدالت سے رجوع نہ کر سکے تو معاشرے کا کوئی بھی ذمہ دار فرد ان کی نمائندگی کر سکتا ہے۔ عدالت نے یہ بھی واضح کیا کہ قومی اہمیت یا اربوں روپے کے منصوبے قانون سے بالاتر نہیں ہوتے اور ہر ترقیاتی عمل کو آئینی اور قانونی حدود کے اندر رہ کر ہی آگے بڑھنا ہوگا۔

یہ مقدمات Great Nicobar Island میں جاری 72 ہزار کروڑ روپے کے مجوزہ منصوبے سے متعلق ہیں، جس میں بندرگاہ، ہوائی اڈہ، بجلی گھر اور دفاعی تنصیبات شامل ہیں۔ درخواست گزاروں نے الزام عائد کیا کہ اس منصوبے کے سبب جنگلاتی قوانین، قبائلی حقوق اور ماحولیات سے متعلق ضوابط متاثر ہو رہے ہیں۔

عدالت نے اس حقیقت کو بھی اہم قرار دیا کہ مینا گپتا ماضی میں وزارتِ قبائلی امور کی سیکریٹری رہ چکی ہیں اور انہوں نے جنگلاتی حقوق کے قانون کی تشکیل میں کردار ادا کیا تھا۔ بنچ نے کہا کہ قبائلی برادریاں اکثر اتنی دور افتادہ اور غیر محفوظ ہوتی ہیں کہ ان کی آواز مرکزی دھارے تک پہنچ ہی نہیں پاتی۔

اس فیصلے کو انسانی حقوق، ماحولیات اور قبائلی شناخت کے تحفظ کی جدوجہد میں ایک اہم سنگِ میل قرار دیا جا رہا ہے۔ عدالت نے یہ پیغام بھی دیا کہ ترقی اگر انسان، جنگل اور تہذیب کو روند کر آگے بڑھے تو انصاف کے دروازے خاموش نہیں رہ سکتے۔

Great Nicobar Project: Calcutta High Court Upholds PILs on Tribal and Forest Rights

Calcutta High Court has delivered a significant ruling by declaring maintainable the Public Interest Litigations challenging alleged violations of forest and tribal rights in the ambitious Great Nicobar infrastructure project.

A Division Bench led by Chief Justice Sujoy Paul and Justice Partha Sarathi Sen rejected the Union Government’s objection that petitioner Meena Gupta lacked locus standi because she resides in Hyderabad and not in the Andaman & Nicobar Islands.

The Court observed that vulnerable tribal communities often cannot approach courts on their own, and therefore any socially conscious citizen may raise issues affecting them. Describing the island tribes as “very vulnerable,” the Bench emphasized that justice must remain accessible even to those living far from the centres of power and administration.

The litigation concerns the ₹72,000-crore mega project proposed in Great Nicobar Island, involving a transshipment port, airport, power facilities, and defence infrastructure. Petitioners alleged violations of the Forest Rights Act and raised concerns over ecological damage and reduction of eco-sensitive zones around protected national parks.

Rejecting the argument that projects of “national importance” should remain beyond judicial scrutiny, the Court firmly stated that even massive developmental projects must comply with constitutional and statutory safeguards.

The Bench also acknowledged Meena Gupta’s long association with tribal welfare and her role in shaping India’s forest rights framework during her tenure in the Ministry of Tribal Affairs.

The ruling is being viewed as an important moment in the ongoing debate between development and environmental justice. It sends a larger constitutional message: economic ambition cannot silence the rights of indigenous communities, forests, and fragile ecosystems.
