اردو شاعری واٹس ایپ میں شیئر کئے جانے کے خلاف دائر کردہ عرضی عدالت نے مسترد کردی
Madhya Pradesh High Court نے ایک اہم فیصلے میں کہا ہے کہ اگر کوئی شخص محض اردو شاعری شیئر کرے، اور اس کے ساتھ نفرت، اشتعال انگیزی یا مذہبی منافرت کو ہوا دینے والا کوئی تبصرہ شامل نہ ہو، تو اسے مختلف مذہبی گروہوں کے درمیان دشمنی پھیلانے کا جرم قرار نہیں دیا جا سکتا۔
عدالت نے ایک سرکاری اسکول کے استاد کے خلاف درج ایف آئی آر کو منسوخ کرتے ہوئے واضح کیا کہ ادب، شاعری اور ثقافتی اظہار کو محض زبان یا جذباتی رنگ کی بنیاد پر مشکوک نہیں بنایا جا سکتا۔ عدالت کے مطابق اصل سوال نیت، سیاق اور اشتعال انگیزی کا ہے، نہ کہ زبان کا۔ تاہم یہ معلوم نہیں ہو سکا کہ وہ شعر کیا تھا.
یہ فیصلہ صرف اردو زبان کے لیے نہیں بلکہ پورے ہندوستانی تہذیبی ورثے کے لیے ایک مثبت پیغام سمجھا جا رہا ہے۔ اردو شاعری صدیوں سے محبت، انسانیت، دردِ دل، رواداری اور روحانی اقدار کی ترجمان رہی ہے۔ میر، غالب، فیض، جگر، فراق اور ساحر جیسے شعرا نے انسان کو انسان سے جوڑنے کا کام کیا، نہ کہ نفرت کی دیواریں کھڑی کرنے کا۔
ادب چاہے اردو میں ہو، ہندی میں، تمل میں، بنگالی میں یا کسی اور زبان میں — اگر وہ محبت، امن، بھائی چارہ اور انسانی احترام کی بات کرتا ہے تو وہ پوری انسانیت کا مشترکہ سرمایہ ہے۔ زبانیں دیواریں نہیں ہوتیں، دلوں کے درمیان پل بناتی ہیں۔
یہ فیصلہ اس حقیقت کی بھی یاد دہانی ہے کہ ایک جمہوری معاشرے میں فن، شاعری اور ادبی اظہار کو خوف کے سائے سے آزاد رہنا چاہیے، کیونکہ قلم جب محبت لکھتا ہے تو معاشرہ نفرت سے محفوظ ہوتا ہے۔

A Significant Judicial Voice in Favour of Urdu Poetry and Literary Freedom
Madhya Pradesh High Court has delivered an important ruling, observing that merely sharing Urdu poetry without commentary, provocation, or intent to incite hatred cannot be treated as an offence of promoting enmity between religious communities.
While quashing an FIR against a government school teacher, the Court emphasized that literature and poetic expression cannot be criminalized simply because of the language in which they are written. The real issue, the Court noted, is whether there is deliberate incitement or malicious intent — not the language itself.
The ruling is being viewed as a reassuring message for India’s shared cultural and literary heritage. Urdu poetry has historically carried themes of love, compassion, humanity, coexistence, and spiritual reflection. Poets such as Mir, Ghalib, Faiz, Jigar, Firaq, and Sahir used poetry to unite hearts rather than divide communities.
Literature — whether written in Urdu, Hindi, Tamil, Bengali, or any other language — deserves appreciation when it speaks of peace, brotherhood, dignity, and human values. Languages are not barriers; they are bridges connecting human souls.
The judgment also serves as a reminder that in a democratic society, art and literature must remain free from fear and suspicion. When poetry spreads empathy instead of hatred, it strengthens the moral fabric of society and preserves harmony among people.
