پاکستانی سرحدی علاقوں میں انہدامی کارروائی پر سپریم کورٹ کی دو ہفتوں کی عبوری روک

نئی دہلی: سپریم کورٹ آف انڈیا نے راجستھان میں پاکستان سے متصل سرحدی علاقوں میں واقع بعض مذہبی و دیگر تعمیرات کے انہدامی عمل پر دو ہفتوں کے لیے عبوری روک لگا دی ہے۔ عدالت نے درخواست گزاروں کو ہدایت کی ہے کہ وہ اپنی عرضیاں راجستھان ہائی کورٹ میں دوبارہ پیش کریں، جہاں ان کے قانونی نکات کا میرٹ کی بنیاد پر جائزہ لیا جائے گا۔

جسٹس پی ایس نرسمہا اور جسٹس الوک آرادھے پر مشتمل بنچ نے واضح کیا کہ سپریم کورٹ نے مقدمے کے اصل نکات پر کوئی رائے قائم نہیں کی ہے اور نہ ہی ہائی کورٹ کے اختیارات میں مداخلت کی ہے۔ عدالت نے صرف یہ عبوری مہلت دی ہے تاکہ درخواست گزار مناسب قانونی چارہ جوئی کر سکیں۔

یہ معاملہ اس وقت سامنے آیا جب راجستھان ہائی کورٹ نے سرحدی اضلاع میں بعض مساجد، درگاہوں اور مدارس کے انہدام کے خلاف دائر درخواستیں مسترد کر دی تھیں۔ مرکزی حکومت کا مؤقف ہے کہ پاکستانی سرحد سے پچاس کلومیٹر کے اندر واقع علاقوں میں قومی سلامتی کے تقاضوں کے تحت سخت نگرانی اور ضابطہ بندی ضروری ہے۔

اطلاعات کے مطابق جمعیۃ علماء ہند کی حقائق پر مبنی رپورٹ کے بعد تقریباً چالیس متاثرین سپریم کورٹ سے رجوع ہوئے تھے۔ جون میں بارمیر، جیسلمیر اور پھلودی سمیت کئی سرحدی علاقوں میں متعدد مساجد اور درگاہوں کے انہدام نے سیاسی بحث کو بھی جنم دیا تھا۔

اپوزیشن جماعتوں، بالخصوص آل انڈیا مجلس اتحاد المسلمین کے صدر اسدالدین اویسی اور کانگریس کے سینئر رہنما اشوک گہلوت نے الزام عائد کیا ہے کہ انہدامی کارروائیاں غیر متناسب طور پر مسلم مذہبی مقامات کو نشانہ بنا رہی ہیں، جبکہ ریاستی حکومت نے ان اقدامات کو قانونی اور انتظامی ضرورت قرار دیا ہے۔

Supreme Court Stays Demolition of Border Structures for Two Weeks, Directs Petitioners to Rajasthan High Court

New Delhi | Alif News: The Supreme Court of India has granted a two-week interim stay on the demolition of certain structures located near the India–Pakistan border in Rajasthan and directed the petitioners to approach the Rajasthan High Court for further relief.

A Bench comprising Justices P.S. Narasimha and Alok Aradhe clarified that it had not examined the merits of the dispute and expressed no opinion on the legality of the proposed demolitions. The Court said the High Court should independently consider the petitions on their merits.

The matter arose after the Rajasthan High Court dismissed petitions challenging the proposed demolition of several mosques, dargahs, and madrasas in the border districts. The Union government has argued that enhanced regulation and surveillance within 50 kilometres of the international border are necessary to address national security concerns.

Around 40 affected persons approached the Supreme Court following a fact-finding exercise reportedly conducted by Jamiat Ulama-i-Hind. The issue gained national attention after the demolition of several mosques and shrines in Barmer, Jaisalmer, and Phalodi during June.

Opposition leaders, including AIMIM president Asaduddin Owaisi and senior Congress leader Ashok Gehlot, have alleged that the demolition drive disproportionately targets Muslim places of worship. The Rajasthan government, however, maintains that the actions are being carried out in accordance with legal and administrative requirements.
