حکومت سے تین روز میں رپورٹ طلب

نئی دہلی، 19 جولائی: دہلی ہائی کورٹ نے معروف ماحولیاتی کارکن اور سماجی رہنما سونم وانگچک کی اہلیہ گیتانجلی جے انگمو کی جانب سے انہیں فوری طور پر صفدر جنگ اسپتال سے کسی نجی اسپتال منتقل کرنے کی درخواست پر فوری راحت دینے سے انکار کرتے ہوئے مرکزی حکومت اور اسپتال انتظامیہ سے تین روز کے اندر صحت سے متعلق تفصیلی رپورٹ طلب کرلی ہے۔ آئندہ سماعت 24 جولائی کو ہوگی۔

عدالت نے ابتدائی سماعت کے دوران کہا کہ موجودہ مرحلے پر ایسا کوئی حکم جاری کرنے کی ضرورت محسوس نہیں ہوتی، کیونکہ وانگچک زیرِ حراست نہیں ہیں اور ان کے اہلِ خانہ کو ان تک رسائی دی جا رہی ہے۔ عدالت نے یہ بھی کہا کہ حکومت نے ان کی بگڑتی ہوئی طبی حالت کے پیشِ نظر اسپتال منتقل کرنے کا فیصلہ کیا، جسے بادی النظر میں غیر قانونی یا من مانی کارروائی قرار نہیں دیا جا سکتا۔

سونم وانگچک کو گزشتہ روز ان کی اکیس روزہ بھوک ہڑتال کے دوران طبیعت خراب ہونے پر دہلی پولیس صفدر جنگ اسپتال لے گئی تھی۔ وہ مختلف تعلیمی اور عوامی مطالبات کے حق میں جاری احتجاج کے دوران مسلسل بھوک ہڑتال پر تھے۔

اہلیہ کے اعتراضات

گیتانجلی انگمو نے عدالت میں مؤقف اختیار کیا کہ انہیں اپنے شوہر کی صحت کے بارے میں مکمل اور شفاف معلومات فراہم نہیں کی جا رہیں، جبکہ ان کے ذاتی ڈاکٹروں اور وکلاء کو بھی آزادانہ رسائی حاصل نہیں۔ انہوں نے الزام لگایا کہ اسپتال میں پولیس کی بڑی نفری کی موجودگی نے اہلِ خانہ کی نقل و حرکت کو محدود کر رکھا ہے، جس سے یہ صورتحال علاج سے زیادہ غیر ضروری پابندی کا تاثر دیتی ہے۔

درخواست میں یہ بھی کہا گیا کہ خاندان کو اپنی پسند کے اسپتال میں علاج کرانے اور آزاد طبی معائنہ کرانے کا بنیادی حق حاصل ہے، جس سے انہیں محروم رکھا جا رہا ہے۔

حکومت کا مؤقف

مرکزی حکومت کی جانب سے عدالت کو بتایا گیا کہ طویل بھوک ہڑتال کے باعث وانگچک کی صحت خطرناک مرحلے میں داخل ہو سکتی تھی، اس لیے انہیں طبی نگرانی میں لانا ضروری تھا۔ سرکاری وکیل نے کہا کہ صفدر جنگ اسپتال کے ماہر ڈاکٹر مسلسل ان کی نگرانی کر رہے ہیں، انہیں زبانی محلول اور پوٹاشیم دیا جا رہا ہے، تاہم انہوں نے رگ کے ذریعے سیال مادہ (IV Fluids) لینے سے انکار کیا ہے۔

حکومت نے یہ بھی مؤقف اختیار کیا کہ سرکاری اسپتال میں علاج کے دوران کسی قسم کا جبری طبی عمل نہیں کیا جا رہا اور اگر ضرورت پڑی تو انہیں آل انڈیا انسٹی ٹیوٹ آف میڈیکل سائنسز (AIIMS) بھی منتقل کیا جا سکتا ہے۔

پوٹاشیم کی سطح پر اختلاف

درخواست میں یہ دعویٰ بھی کیا گیا کہ صفدر جنگ اسپتال کی رپورٹ اور ایک آزاد لیبارٹری کی رپورٹ میں پوٹاشیم کی مقدار کے حوالے سے فرق پایا گیا، جس کے باعث اہلِ خانہ نے طبی معلومات کی شفافیت پر سوال اٹھایا ہے۔ حکومت نے اس الزام پر عدالت میں تفصیلی جواب پیش کرنے کے لیے مہلت طلب کی۔

Delhi High Court Declines Immediate Plea to Shift Sonam Wangchuk from Government Hospital, Seeks Health Status Report

New Delhi, July 19: The Delhi High Court has declined to grant immediate relief on a petition filed by environmentalist and social activist Sonam Wangchuk’s wife, Gitanjali J. Angmo, seeking his transfer from Safdarjung Hospital to a private medical facility. The court has directed the Centre and hospital authorities to submit a detailed health status report within three days and scheduled the next hearing for July 24.

The court observed that, at this stage, no interim order was warranted as Wangchuk was not under detention and his close family members had been allowed access to him. It further noted that the government’s decision to hospitalise him appeared to have been taken in view of his medical condition and could not, prima facie, be termed arbitrary.

Wangchuk was taken to Safdarjung Hospital on Saturday after his health reportedly deteriorated during the 21st day of his indefinite hunger strike in support of ongoing public protests over education-related issues.

Wife Raises Concerns

In her petition, Gitanjali Angmo alleged that the family was not receiving complete and transparent information regarding Wangchuk’s health. She also claimed that his personal doctors and legal representatives were being denied unrestricted access.

The plea further alleged that the heavy deployment of police personnel inside the hospital had severely restricted the family’s movement, creating an atmosphere that, according to the petitioner, resembled involuntary confinement rather than routine medical care.

She urged the court to permit Wangchuk’s transfer to a hospital of the family’s choice and allow an independent medical examination.

Government’s Stand

Representing the Centre, government counsel argued that Wangchuk’s prolonged fast had created a potentially life-threatening medical situation requiring immediate intervention. The court was informed that doctors at Safdarjung Hospital were closely monitoring his condition and had administered oral fluids and potassium supplements with his consent, although he had declined intravenous (IV) treatment.

The government also maintained that no forced medical procedure was being carried out and suggested that he could be shifted to AIIMS if required.

Potassium Report Dispute

The petition additionally questioned the hospital’s medical findings, alleging discrepancies between Safdarjung Hospital’s potassium test results and those obtained through an independent laboratory. The government has been asked to respond to these allegations in its status report.
