ایک بار پھر ملک کی ایک تاریخی اور عالمی شہرت یافتہ عمارت عدالت کے دروازے تک پہنچ گئی ہے۔ اس مرتبہ الہ آباد ہائی کورٹ میں ایک درخواست دائر کی گئی ہے جس میں یہ دعویٰ کیا گیا ہے کہ تاج محل دراصل "تیجو مہالیہ” نامی ایک قدیم شیو مندر تھا، اور آگرہ کی عدالت کی جانب سے سروے کے لیے ایڈووکیٹ کمشنر مقرر نہ کرنے کے فیصلے کو چیلنج کیا گیا ہے۔

یہ مقدمہ ابھی زیرِ سماعت ہے اور عدالت نے اس پر کوئی حتمی فیصلہ نہیں دیا۔ اس لیے یہ واضح رہنا چاہیے کہ درخواست گزار کے دعوے ابھی صرف دعوے ہیں، جن کی عدالتی جانچ ہونا باقی ہے۔

لیکن اس مقدمے نے ایک بڑا سوال ضرور کھڑا کر دیا ہے۔ کیا ہندوستان اپنی توانائیاں مستقبل کی تعمیر پر صرف کرے گا یا ماضی کے تنازعات کو مسلسل زندہ رکھنے میں؟

گزشتہ چند برسوں میں متعدد مساجد اور مذہبی مقامات کے بارے میں اسی نوعیت کے مقدمات عدالتوں میں سامنے آتے رہے ہیں۔ اب اگر تاج محل جیسی عالمی ثقافتی وراثت بھی اسی بحث کا حصہ بن جائے تو اس سے نہ صرف ملک کی بین الاقوامی ساکھ متاثر ہو سکتی ہے بلکہ سماجی ہم آہنگی پر بھی منفی اثرات مرتب ہونے کا اندیشہ ہے۔

ہندوستان اس وقت بے روزگاری، مہنگائی، تعلیم، صحت، ماحولیات اور اقتصادی ترقی جیسے بے شمار بنیادی مسائل سے دوچار ہے۔ عوام کی توقع ہے کہ ریاست اور معاشرہ اپنی توانائیاں انہی حقیقی مسائل کے حل پر صرف کریں، نہ کہ ایسے تنازعات پر جو معاشرے میں مزید تقسیم پیدا کریں۔

عدالتوں کا کام قانون اور شواہد کی بنیاد پر فیصلے کرنا ہے، اور ہر شہری کو قانونی چارہ جوئی کا حق حاصل ہے۔ تاہم یہ بھی اتنا ہی ضروری ہے کہ تاریخ کے پیچیدہ سوالات کو سیاسی اور مذہبی کشمکش کا ذریعہ بنانے کے بجائے علمی تحقیق، معتبر تاریخی شواہد اور آئینی اصولوں کی روشنی میں دیکھا جائے۔

تاج محل صرف ایک عمارت نہیں بلکہ ہندوستان کی تہذیبی شناخت، فنِ تعمیر کی عظیم روایت اور عالمی ثقافتی ورثے کی علامت ہے۔ ایسی یادگاروں کو نئے تنازعات کا میدان بنانے کے بجائے قومی اتحاد، باہمی احترام اور مشترکہ تہذیبی ورثے کی علامت کے طور پر محفوظ رکھنا وقت کی اہم ضرورت ہے۔

ملک کی حقیقی طاقت اس کی مذہبی و ثقافتی تنوع، آئینی اقدار اور اجتماعی ہم آہنگی میں ہے۔ اگر یہی بنیادیں کمزور ہوں گی تو ترقی کا خواب بھی کمزور پڑ جائے گا۔

The Taj Mahal Enters Another Legal Dispute: Is This the Direction India Needs?

India’s globally admired monument, the Taj Mahal, has once again become the subject of litigation. A petition before the Allahabad High Court challenges an Agra court’s refusal to appoint an Advocate Commissioner to survey the monument, while reiterating the claim that the Taj Mahal was originally a Hindu temple known as "Tejo Mahalaya.”

It is important to remember that these are claims made by the petitioners. The High Court has not delivered any verdict on their merits, and the matter remains under judicial consideration.

Nevertheless, the case raises a broader national question. Should India’s public discourse continue to revolve around historical and religious disputes, or should it focus on addressing the pressing challenges of the present and the future?

Over the past few years, several legal disputes concerning places of worship have reached the courts. If even the Taj Mahal—a globally recognised symbol of India’s cultural heritage—becomes part of this continuing cycle of litigation, it risks affecting not only social harmony but also India’s international image.

The country faces urgent concerns including employment, inflation, education, healthcare, environmental sustainability, and economic growth. These are the issues that deserve sustained public attention and policy focus.

Every citizen has the constitutional right to seek legal remedies, and the judiciary must decide such matters solely on the basis of law and evidence. At the same time, historical questions should be examined through rigorous scholarship, credible evidence, and constitutional values—not through narratives that deepen social divisions.

The Taj Mahal represents far more than a single historical monument. It is an enduring symbol of India’s architectural brilliance and shared cultural legacy. Preserving such heritage as a source of unity rather than conflict is in the larger national interest.

A nation’s greatest strength lies in its constitutional commitment, pluralism, and social cohesion. Without these foundations, lasting peace and meaningful development become increasingly difficult to achieve.
