کرناٹک میں مختلف سماجی تنظیموں اور کارکنوں نے حکومت کی جانب سے جلد بازی میں جاری کیے جانے والے رہائشی اور مستقل رہائشی اسناد (Residence Certificate اور Permanent Residence Certificate) کی افادیت پر سوال اٹھاتے ہوئے خدشہ ظاہر کیا ہے کہ یہ واضح نہیں کہ آیا الیکشن کمیشن انہیں خصوصی نظرثانی (SIR) کے دوران قبول کرے گا یا نہیں۔

کارکنوں نے کہا کہ عام رہائشی سند (Residence Certificate) موجودہ پتہ ثابت کرنے کے لیے آدھار، راشن کارڈ، بجلی یا پانی کے بل، یا کرایہ نامہ جیسے دستاویزات کی بنیاد پر حاصل کی جا سکتی ہے، جبکہ مستقل رہائشی سند (Permanent Residence Certificate) کے لیے ریاست کے ساتھ طویل مدتی تعلق ثابت کرنا ضروری ہوتا ہے، جیسے کئی برسوں کی رہائش، ریاست میں تعلیم، والدین کی مستقل رہائش یا جائیداد کی ملکیت۔

ان کا کہنا ہے کہ الیکشن کمیشن کی جانب سے خصوصی نظرثانی کے لیے طلب کیے گئے 11 دستاویزات محض ووٹر کی شناخت کی جانچ نہیں بلکہ شہریت سے متعلق تعلق کا ثبوت طلب کرتے ہیں، جن میں 2002 سے قبل کی رہائش کے شواہد کو خاص اہمیت دی گئی ہے۔

سماجی کارکن اور کالم نگار شیواسندر نے مغربی بنگال کی مثال دیتے ہوئے کہا کہ وہاں بھی خصوصی نظرثانی کے دوران حکومت کی جانب سے جاری کردہ ڈومیسائل سرٹیفکیٹ پیش کیے گئے تھے، لیکن الیکشن کمیشن نے کئی معاملات میں انہیں مقررہ معیار پر پورا نہ اترنے کی بنیاد پر قبول نہیں کیا۔

انہوں نے کہا کہ الیکشن کمیشن صرف سرٹیفکیٹ کی موجودگی نہیں بلکہ اس کے اجراء کے طریقۂ کار، مجاز افسر اور متعلقہ حکومتی احکامات کی مکمل پابندی کو بھی اہمیت دیتا ہے۔ ان کے مطابق سپریم کورٹ بھی اس معاملے میں الیکشن کمیشن کے اختیارات کی توثیق کر چکی ہے۔

کارکنوں کا کہنا ہے کہ اصل سوال یہ نہیں کہ کسی کے پاس رہائشی سند موجود ہے یا نہیں، بلکہ یہ ہے کہ آیا وہ دستاویز الیکشن کمیشن کی تمام شرائط پر پوری اترتی ہے۔ اسی لیے حکومت کی جانب سے جلد بازی میں جاری کیے جانے والے سرٹیفکیٹس کی افادیت پر اب بھی سوالات برقرار ہیں۔

Uncertainty Over Whether Election Commission Will Accept Residence Certificates

Civil society groups and activists in Karnataka have expressed doubts over whether residence and permanent residence certificates being issued by the State government will be accepted by the Election Commission during the Special Intensive Revision (SIR) of electoral rolls.

They explained that a Residence Certificate (RC) can be obtained using documents such as Aadhaar, ration card, electricity or water bills, or a rental agreement to establish a person’s current address. In contrast, a Permanent Residence Certificate (PRC) requires proof of a long-term connection with the State, including years of residence, education in Karnataka, parents’ residence, or property ownership.

According to the activists, the 11 documents sought by the Election Commission go beyond routine voter verification and seek to establish a person’s link to citizenship, with particular emphasis on residence before 2002.

Activist and columnist Shivasundar cited the example of West Bengal, where domicile certificates issued by the State government were submitted during a similar revision exercise. However, the Election Commission reportedly rejected many of them, stating that they did not satisfy the prescribed requirements.

He said the Commission examines not only the certificate itself but also whether it was issued by the competent authority and strictly in accordance with the prescribed legal procedure. He added that the Supreme Court has upheld the Election Commission’s authority in such matters.

According to the activists, the real issue is not merely possessing a residence certificate but whether it fully complies with the Election Commission’s requirements. They therefore questioned whether certificates issued in haste by the State government would ultimately serve the intended purpose.
