کرناٹک کے وزیر داخلہ پرینک خرگے نے راشٹریہ سویم سیوک سنگھ (آر ایس ایس) کو چیلنج کرتے ہوئے کہا ہے کہ وہ یہ ثابت کرے کہ آخر کس قانون کے تحت یہ تنظیم حکومت کے سامنے جوابدہ ہونے سے مستثنیٰ ہے۔ ان کا کہنا تھا کہ جس ملک میں ایک معمولی ریڑھی فروش کو بھی سرکاری طور پر رجسٹر ہونا پڑتا ہے، وہاں آر ایس ایس جیسی بڑی تنظیم قانون سے بالاتر نہیں ہو سکتی۔

ڈی کن ہیرالڈ کے مطابق 10 جون کو دیے گئے اپنے بیان میں کانگریس رہنما نے آر ایس ایس کے قائدین کو دعوت دی کہ وہ یا تو انہیں بنگلورو میں واقع تنظیم کے صدر دفتر ’’کیشوا کرپا‘‘ بلا کر متعلقہ قانونی دستاویزات دکھائیں یا پھر ان کے دفتر آ کر ثبوت پیش کریں۔

خرگے نے کہا:

“آر ایس ایس مجھے اپنے کیشوا کرپا ہیڈکوارٹر بلائے اور وہ قانون دکھائے جس کے تحت وہ حکومت کے سامنے جوابدہ نہیں ہے۔ یا پھر وہ میرے دفتر آئیں اور دستاویزات پیش کریں۔ وہ یہ ثابت کریں کہ انہیں آئینی تقاضوں سے استثنا حاصل ہے۔ اگر میں غلط ثابت ہوا تو معذرت کر لوں گا، ورنہ انہیں اپنی غلطی تسلیم کرنی ہوگی۔”

پرینک خرگے گزشتہ کچھ عرصے سے آر ایس ایس اور بھارتیہ جنتا پارٹی (بی جے پی) کی نظریاتی سرپرست تنظیم پر مسلسل تنقید کر رہے ہیں۔ یہ تنازع اس وقت مزید شدت اختیار کر گیا جب آر ایس ایس کے سربراہ Mohan Bhagwat نے دعویٰ کیا کہ تنظیم کو باضابطہ رجسٹریشن کی ضرورت نہیں ہے۔

موہن بھاگوت کے مطابق آر ایس ایس ایک ’’افراد کے مجموعے‘‘ (Body of Individuals) کے طور پر کام کرتی ہے اور موجودہ قانونی دفعات کے تحت اس کی حیثیت تسلیم شدہ ہے۔

انہوں نے کہا:

“ہمیں ‘باڈی آف انڈیویجولز’ کے زمرے میں رکھا گیا ہے اور ہم ایک تسلیم شدہ تنظیم ہیں۔ محکمہ انکم ٹیکس نے ہم سے ٹیکس کا مطالبہ کیا تھا جس پر قانونی مقدمہ چلا۔ عدالت نے قرار دیا کہ ہم ایک باڈی آف انڈیویجولز ہیں اور ہماری گرو دکشنا (عطیات) کو انکم ٹیکس سے استثنا حاصل ہے۔”

خرگے کے حالیہ بیانات نے آر ایس ایس کی قانونی حیثیت، رجسٹریشن اور آئینی جوابدہی کے حوالے سے ایک نئی سیاسی بحث کو جنم دے دیا ہے۔

Priyank Kharge Challenges RSS to Prove It Is Exempt from Government Accountability

Karnataka Home Minister Priyank Kharge has challenged the Rashtriya Swayamsevak Sangh (RSS) to demonstrate under which law it is exempt from being accountable to the government. He argued that in a country where even street vendors are required to register with authorities, an organisation as large as the RSS cannot be above the law.

According to Deccan Herald, speaking on June 10, the Congress leader invited RSS functionaries either to host him at the organisation’s Keshava Krupa headquarters in Bengaluru or to visit his office with documentary evidence supporting their legal status.

Kharge said:

“Let the RSS call me to its Keshava Krupa headquarters. Let them show me the law under which they are exempted from being accountable to the government. Or let them come to my office with documents. Let them show how they are exempt from Constitutional provisions. If I’m wrong, I’ll apologise. Otherwise, let them make amends.”

The remarks come amid an ongoing debate over the legal status of the RSS, the ideological mentor of the ruling Bharatiya Janata Party (BJP).

The controversy intensified after RSS chief Mohan Bhagwat stated that the organisation does not require formal registration and functions as a “body of individuals” recognised under existing legal provisions.

Bhagwat said:

“We are categorised as a body of individuals, and we are a recognised organisation. The Income Tax Department had asked us to pay income tax, and there was litigation. The court held that this is a body of individuals, and our guru dakshina (donations) was exempted from income tax.”

Kharge’s challenge has reignited political and legal discussions regarding the RSS’s organisational structure, registration status, and accountability under India’s constitutional framework.
