Karnataka High Court نے ایک اہم فیصلے میں یہ واضح کیا ہے کہ اسکولوں میں قومی نغمہ “وندے ماترم” کے تمام اشعار گانا لازمی نہیں ہے۔ عدالت نے وزارتِ داخلہ کے ایک سرکلر کے خلاف دائر مفادِ عامہ کی درخواست (PIL) کو مسترد کر دیا۔
چیف جسٹس Vibhu Bakru اور جسٹس C. M. Poonacha پر مشتمل بنچ نے کہا کہ وزارتِ داخلہ کے سرکلر میں لفظ “may” استعمال ہوا ہے، جس کا مطلب ہے کہ یہ صرف ایک مشورہ ہے، کوئی لازمی حکم نہیں۔
درخواست گزار نے مؤقف اختیار کیا تھا کہ اس نغمے کے کچھ اشعار میں ہندو دیویوں کا ذکر آتا ہے، جو آئین کے سیکولر ڈھانچے سے متصادم ہے۔ تاہم عدالت نے قرار دیا کہ:
- اس حوالے سے کوئی قانونی پابندی موجود نہیں
- نغمہ گانے یا نہ گانے پر کوئی سزا مقرر نہیں
- خدشات محض قیاس آرائی پر مبنی ہیں
عدالت نے درخواست کو قبل از وقت (premature) قرار دیتے ہوئے مسترد کر دیا۔
اس سے قبل Supreme Court of India بھی اسی نوعیت کی درخواست کو مسترد کر چکی ہے اور واضح کر چکی ہے کہ “وندے ماترم” گانا لازمی نہیں بنایا گیا۔
Court Clarifies: Singing All Stanzas of “Vande Mataram” Not Mandatory

The Karnataka High Court has ruled that singing all stanzas of the national song “Vande Mataram” in schools is not mandatory, dismissing a Public Interest Litigation challenging a circular issued by the Ministry of Home Affairs.
A division bench comprising Chief Justice Vibhu Bakru and Justice C. M. Poonacha observed that the circular uses the word “may”, indicating that it is advisory and not compulsory.
The petitioner had argued that certain stanzas invoke Hindu deities such as Durga, Saraswati, and Lakshmi, which could conflict with the secular fabric of the Constitution. However, the Court held that:
- There is no statutory requirement governing the national song
- No penal consequences exist for not singing it
- Concerns about discrimination are vague and speculative
The Court dismissed the plea as premature, emphasizing that no institution has been compelled to enforce the directive.
Earlier, the Supreme Court of India had also declined to entertain a similar petition, reiterating that singing Vande Mataram has not been made compulsory.
