’’جنا نائگن‘‘ معاملہ: فلم، عدالت اور سنسر کی کشمکش کا ایک باب اختتام کو پہنچا

مدراس ہائی کورٹ میں اداکار وجے کی فلم ’’جنا نائگن‘‘ سے متعلق سنسر سرٹیفکیٹ کے تنازعے میں ایک نیا موڑ سامنے آیا ہے۔ فلم کے پروڈیوسر KVN پروڈکشنز نے عدالت کو مطلع کیا ہے کہ وہ سنٹرل بورڈ آف فلم سرٹیفکیشن (CBFC) کے خلاف دائر اپنی عرضی واپس لینا چاہتے ہیں۔

پروڈیوسرز کی جانب سے ان کے وکیل وجیان سبرامنیم کے ذریعے عدالت کے رجسٹری کو ارسال کردہ مکتوب میں کہا گیا ہے کہ فلم پر نظرِ ثانی کے عمل کو قبول کرتے ہوئے وہ اب قانونی چارہ جوئی کو آگے بڑھانے کے خواہاں نہیں۔

یہ معاملہ اب 10 فروری 2026 کو جسٹس پی ٹی آشا کے روبرو ’’برائے واپسی‘‘ کے عنوان کے تحت پیش کیے جانے کا امکان ہے۔

یہ فلم، جو اداکار وجے کے سیاسی میدان میں باضابطہ داخلے سے قبل ان کی آخری فلم تصور کی جا رہی ہے، اس وقت قانونی پیچیدگیوں میں الجھ گئی تھی جب CBFC کی جانب سے سرٹیفکیشن میں تاخیر ہوئی۔
پروڈیوسرز کا موقف تھا کہ مجوزہ ترامیم کے بعد بھی ’’UA‘‘ سرٹیفکیٹ جاری نہیں کیا گیا، بلکہ چیئرپرسن نے اچانک فلم کو ری وائزنگ کمیٹی کے سپرد کر دیا۔

CBFC نے عدالت میں یہ مؤقف اختیار کیا کہ ایگزامننگ کمیٹی کے ایک رکن کی شکایت پر، جس میں مذہبی جذبات اور افواج کی تصویر کشی پر اعتراضات اٹھائے گئے تھے، فلم کو ری وائزنگ کمیٹی کے پاس بھیجا گیا۔

9 جنوری کو سنگل جج نے پروڈیوسرز کے حق میں فیصلہ دیتے ہوئے CBFC کو فوری سرٹیفکیٹ جاری کرنے کی ہدایت دی، مگر بعد ازاں ڈویژن بینچ نے اس حکم پر روک لگاتے ہوئے نہ صرف عدالتی عمل میں عجلت پر سخت ریمارکس دیے بلکہ معاملہ دوبارہ سماعت کے لیے واپس بھیج دیا۔

اگرچہ 27 جنوری کو ڈویژن بینچ کا حکم آ چکا تھا، مگر نہ تو عرضی میں ترمیم کی گئی اور نہ ہی سماعت ہوئی۔ بالآخر اب پروڈیوسرز نے کیس واپس لینے کا فیصلہ کیا ہے۔

یہ معاملہ اس سوال کو ایک بار پھر زندہ کر گیا ہے کہ
تخلیقی آزادی، ادارہ جاتی اختیار اور عدالتی وقار کے درمیان توازن کہاں قائم ہونا چاہیے؟

‘Jana Nayagan’ Case: A Chapter Closes in the Long Dialogue Between Cinema and Censorship

The legal battle surrounding actor Vijay’s film Jana Nayagan has reached a decisive turn, as the producers have chosen to withdraw their petition before the Madras High Court against the Central Board of Film Certification.

Through a letter submitted by counsel Vijayan Subramaniam, KVN Productions informed the court registry that they intend to proceed with the review process of the film and no longer wish to pursue litigation.

The matter is likely to be listed on February 10, 2026, before Justice P.T. Asha under the caption “For Withdrawal.”

Jana Nayagan, believed to be the final cinematic outing of Vijay before his formal entry into politics, became entangled in legal proceedings after delays in certification by the CBFC.

The producers had contended that despite complying with suggested modifications for a “UA” certificate, the certification was withheld, and the film was unexpectedly referred to a Revising Committee.
The CBFC justified its decision by citing a complaint from a member of the Examining Committee, alleging that certain scenes could hurt religious sentiments and misrepresent the armed forces.

While a single judge initially ruled in favour of the producers and directed immediate certification, the Division Bench later stayed and set aside that order, citing procedural lapses and lack of opportunity for the Board to be heard. The matter was remanded for fresh adjudication, with directions to amend the original prayer — a step that was never taken.

With the producers now opting to withdraw the case, this episode quietly concludes — leaving behind larger questions about creative freedom, institutional authority, and the pace of justice in cultural disputes.
